Gabriel Aubry** and Olivier Martinez got into a physical altercation at Halle Berry**'s home on Thursday, Nov. 22, Us Weekly has confirmed.

A Hollywood division watch commander for the LAPD tells Us "the investigation is ongoing" and says "the cause of the fight between the two men is unknown." However, a law enforcement sources tell TMZ the fight began when Aubry showed up with his daughter, Nahla, 4, for a custodial handoff to Berry. After Martinez (the Academy Award winner's fiance) reportedly told the model, "We have to move on," Aubry pushed the actor and threw a punch at him.

The two continued to struggle until Martinez managed to pin Aubry to the ground, according to TMZ. The site also claims Aubry sustained a broken rib, contusions on his face and a possible head injury. Martinez may have broken his hand and suffered neck injuries.

Police were called to make a citizen's arrest for battery against Aubry, 36. The watch commander tells Us that "no one has been booked yet. One man was transported with unknown injuries to a local hospital. I do not know the extent of the injuries or if he remains in the hospital."

According to Radar Online, Martinez, Aubry and Berry were cordial during a pre-holiday party Nov. 21.

Earlier this month, a judge ruled that Berry, 46, will not be able to move to France full-time with Nahla. Following their April 2010 split, the exes have been engaged in a nasty custody battle.

Twice-married Berry has been engaged to her Dark Tide costar Martinez, 46, since late 2011. Aubry briefly dated Kim Kardashian in late 2010.

Its over move on! .....first the nanny now the leading man in halle life.he sure do show sign of anger problem .......not only tht, he always seem to do it in the child present, no regard. He's from abad family setting.

I agree with elilovesme. I think they are all wrong but its pathetic she tried to move his child a country away from her dad. Hurts the child the most. Then when the adults get into it ( I do believe it was a set-up) she files a restraining order to stay away from the child. Keep it between the adults, a child shouldn't have to suffer by not having contact with dad. Halle should have handled the situation by herself, her bf shouldn't be in it. I don't really care for the dad after the nanny thing but now I wonder if Halle set that up too. I used to be a fan of hers until she started putting her selfish wants ahead of her child's needs.

Years ago I would've said, I'd fight over Halle Berry. But now, not some much. Not worth it. And how convenient for US Weekly to somehow find a way to put Kim Kardashians name related to the article.

@Racheda, yea you are right, because no black man would have done her that bad! Lol She's having to pay him 20k in child support a month, when he only has joint custody! What type of expenses does he have that warrants 20k a month when he only has her a couple of weeks out of the month? That judge must really dislike her! Halle hasnt been doing that many movies or endorsements lately to be able to afford that! She really knows how to pick them. No matter the race she chooses, she lucks up and picks a sorry joker everytime!
